NJAC 10A:31-25.6 Inmates ineligible for Work Release ProgramTITLE 10A. CORRECTIONS CHAPTER 31. ADULT COUNTY CORRECTIONAL FACILITIES SUBCHAPTER 25. WORK AND VOCATIONAL TRAINING RELEASE PROGRAM N.J.A.C. 10A:31-25.6 (2012)(a) The following shall make an inmate ineligible for participation in the Work Release Program: 1. Untried detainers for criminal offenses or immigration detainers; 2. Current convictions involving arson offenses; 3. Previous convictions for arson offenses, even if the current conviction is for an offense(s) other than arson; and/or 4. The applicable provisions of related statutes of the State of New Jersey, such as, but not limited to, Michaels Law at N.J.S.A. 39:4-51. (b) Pursuant to N.J.S.A. 30:8-44.1, no person confined to an adult county correctional facility shall be eligible to participate in any work release or vocational training release program if he or she has been convicted of any of the following: 1. Any crime involving a sexual offense or child molestation as set forth in N.J.S.A. 2C:14-1 et seq.; 2. Any crime endangering the welfare of children or incompetents which concerns sexual conduct which would impair or debauch the morals of the child or an incompetent, as set forth in N.J.S.A. 2C:24-4 and N.J.S.A. 2C:24-7; 3. Any crime involving the manufacture, transportation, sale or possession, with the intent to sell or distribute, of a controlled dangerous substance or a controlled dangerous substance analog, as defined in the Comprehensive Drug Reform Act of 1986, P.L. 1987, c.106 (C.2C:35-1 et al.); or 4. Any crime involving the use of force or the threat of force upon a person or property including: armed robbery, aggravated assault, kidnapping, arson, manslaughter and murder. N.J.A.C. 10A:31-25.3 (2012) 10A:31-25.3 Benefit to inmates (a) Participation in the Work Release Program provides the following benefits to inmates: 1. Provides inmates the opportunity to participate in full time normal employment or vocational training in the community; 2. Permits inmates the opportunity to develop or strengthen good work habits and skills; 3. Affords inmates opportunities to continue or strengthen constructive ties with family, friends and the community; 4. Permits the pre-release preparation of inmates and the opportunity to evaluate the readiness of these inmates for release to the community; 5. Permits disbursements to be made from inmate earnings to help defray the cost of incarceration, support dependents, reduce debts and pay court fines; 6. Enables inmates to accumulate savings to help meet financial needs or burdens after release from confinement; 7. Provides inmates the opportunity to meet family needs; and 8. Provides inmates the opportunity to earn credits which will reduce the time to be served on the inmates sentence. |

3. Notice of the obligation to register shall be provided as follows: (1) A court imposing a sentence, disposition or order of commitment following acquittal by reason of insanity shall notify the defendant of the obligation to register pursuant to section 2 of this act. (2) The Department of Corrections, the Administrative Office of the Courts, the Juvenile Justice Commission established pursuant to section 2 of P.L.1995, c.284 (C.52:17B-170) and the Department of Human Services shall (a) establish procedures for notifying persons under their supervision of the obligation to register pursuant to this act and (b) establish procedures for registration by persons with the appropriate law enforcement agency who are under supervision in the community on probation, parole, furlough, work release or similar program outside the facility, and registration with the appropriate law enforcement agency of persons who are released from the facility in which they are confined without supervision. (3) The Division of Motor Vehicles in the Department of Law and Public Safety shall provide notice of the obligation to register pursuant to this section in connection with each application for a license to operate a motor vehicle and each application for an identification card issued pursuant to section 2 of P.L.1980, c.47 (C.39:3-29.3). (4) The Attorney General shall cause notice of the obligation to register to be published in a manner reasonably calculated to reach the general public within 30 days of the effective date of this act. |

2. a. No person confined in a correctional or juvenile facility or involuntarily committed who is required to register under the provisions of P.L.1994, c.133 (C.2C:7-1 et seq.) shall be released from that confinement prior to expiration of sentence or termination from supervision or of custody, as the case may be, until the address set forth on his form of registration as his proposed place of residence has been verified as valid in accordance with procedures established by the Attorney General, which shall include provisions governing written notification of appropriate State and local officials. The address verification shall take place prior to the scheduled date of release and shall be provided to the department to which the individual is confined or committed or the commission, as appropriate. Nothing in this section shall be construed to require a person to be held in confinement or involuntary commitment beyond the date of expiration of that persons sentence, termination from supervision, or judicially ordered termination of custody, as the case may be. b.No person under supervision in the community on probation, parole, furlough, work release or any similar program who is required to register under the provisions of P.L.1994, c.133 (C.2C:7-1 et seq.) shall be released from that supervision until the address set forth on his form of registration as his proposed place of residence has been verified as valid. Get your Flag Ready! Please join us in this FLY THE FLAG campaign and PLEASE forward this to everyone in your address book asking them to also forward it.
On September 11th, an American flag should be displayed outside every car, home, apartment, office, and store in the United States. Every individual should make it their duty to display an American flag on the anniversary of one our country's worst tragedies. We have extra flags in our office reception area. If you forward this post to at least 11 people and each of those people does the same, you get the idea.
Our patriotism pulled us through some tough times and it shouldn't take another attack to galvanize us in solidarity. Our American flag is the fabric of our country and together we can prevail over terrorism of all kinds.
Take a moment to think back to how you felt on 9/11 and let those sentiments guide you.
Fly an American flag of any size on 9/11. Honestly, Americans should fly the flag year-round, but if you don't, then at least make it a priority on this day.

(a) When the inmate has been accepted into the Work Release Program and the appropriate applications and plans have been completed, the County Work Release Administrator shall provide an orientation to the inmate.
(b) The orientation shall ensure that the inmate is made aware of and has a clear understanding of the rules, regulations and conditions governing the Work Release Program.
(c) The County Work Release Administrator or designee shall also ensure that the employer is made aware of the rules and regulations and of the employers responsibilities concerning the Work Release Program.
(d) The County Work Release Administrator shall make periodic evaluations of the extent of family needs and of job and vocational training sites to ensure that the rules and regulations governing the Work Release Program are not being violated.
