Increased penalty for drug distribution near public housing consitutional. State v. Brooks 366 NJ Super. 447 (App. Div. 2004).
1. The primary factors governing due process entrapment are: (a) the justification for the police in targeting the defendant as a criminal suspect; and (b) the nature and extent of the government's actual involvement in bringing about the crime. 2. The second-degree crime of distribution of CDS within 500 feet of a public-housing facility, N.J.S.A. 2C:35-7.1, is neither discriminatory on its face not in its impact on the poor and minority populations comprising a large percentage of public-housing residents.
