DWI - Protocol Should Be Followed; State v. Kashi, ___ NJ Super. ___ A-3319-01T2 (App. Div. June 5, 2003)


Defendant was charged with driving while intoxicated. The municipal court judge found defendant guilty based on the Breathalyzer reading but also found that testimony about defendant's physical condition did not prove beyond a reasonable doubt he was intoxicated. In a trial de novo, defendant was found guilty on both theories. On appeal, we rejected the Breathalyzer readings as unreliable because the officer did not comply with the proper protocols in administering the test, but affirmed the finding of guilty based on the physical observations. There was no violation of double jeopardy because he was not acquitted in municipal court.
