Probable Cause for Search Existed, thus, Prejudice Prong of Strickland Test Not Met Despite Counsel's Failure to File State v. Roper ___ NJ Super

In State v. Roper, 362 NJ Super. 248 (App. Div. 2003), the court remanded for the purpose of having the motion judge address on its merits defendant's claim that trial counsel had rendered ineffective assistance by failing to file a motion to suppress evidence. On remand, the motion judge reviewed the trial testimony relevant to such a suppression motion and found that probable cause existed for the search in question. The court affirms that finding.
